By accessing this website, placing an order, or purchasing our products, you agree to be bound by these Terms & Conditions.
These Terms & Conditions should be read together with our Privacy Policy, Shipping & Delivery Policy and Refund & Return Policy, each available on this website.
- General
These Terms & Conditions govern your use of this website and any purchases made through it. We reserve the right to modify these terms at any time without prior notice. Any changes will be published on this page with an updated revision date. Continued use of the website or placing an order after modifications constitutes acceptance of the updated terms. - Products
We sell genuine Mitsubishi Heavy Industries air conditioning units (including the Kaze (CXP Series), Aki (YYM Series), and Hoshi (YYF series)) on a supply-only basis. Purchases cover product hardware only and exclude installation services. Delivery is managed and executed separately by our appointed third-party logistics partners.
Product images are for illustrative purposes only; actual product appearance or packaging may vary. We make reasonable efforts to ensure specifications, pricing, and availability details are accurate, but we reserve the right to correct errors.
- Orders & Payment
All orders placed on this website are subject to product availability and acceptance by us. Payment must be completed in full at checkout via our authorised third-party payment gateways. Customers are responsible for reviewing order details (such as product series, horsepower, and delivery details) prior to final submission and order confirmation.
An order confirmation does not guarantee stock availability. If an item is out of stock or cannot be fulfilled, we will notify you and issue a full refund.
- Order Cancellation
You may request to cancel an order before it has been dispatched from our warehouse or handed over to our delivery partners by contacting us using the details in Section 15 (Contact). Once an order has been dispatched, cancellation requests are strictly governed by our Return & Refund Policy. - Pricing
All displayed product prices are in Malaysian Ringgit (MYR) and cover hardware only. Displayed prices exclude delivery fees and third-party installation costs. Shipping charges are not collected at online checkout. Applicable delivery fees will be communicated and collected directly by our appointed third-party logistics partner prior to delivery. Prices are subject to change without prior notice. - Delivery
Delivery is managed and executed directly by our appointed third-party logistics partners.
- Scheduling: Once your order has been accepted and processed for fulfilment, our appointed logistics partner will contact you directly (typically within 2 business days) to coordinate delivery.
- Order Tracking: Once your order has been placed, you may contact our Customer Careline (see Section 15 Contact) to check the status of your order and delivery.
- Inspection & Risk: Risk of loss or physical damage passes to the customer upon delivery to the designated address. Customers or their appointed representatives must inspect external packaging and physical units prior to signing the delivery acceptance documentation. Signing confirms the hardware was received in good physical condition. Any subsequent functional or operational issues discovered after delivery are subject to evaluation under Section 8 (Product Warranty).
- Delays: Transport delays caused by circumstances outside our reasonable control (including but not limited to weather, restricted site access, etc) will be communicated directly by our logistics partners as set out in our Shipping & Delivery Policy.
- Installation Disclaimer & Third-Party Services
Trio Electric & Automation (M) Sdn Bhd does not provide, manage or assign installation services.
- Customer Choice: Customers are free to select and engage any qualified independent installer of their choice.
- Independent Delivery Partners: Any optional installation services offered independently by our delivery partners or outside contractors are separate arrangements strictly between the customer and that third party.
- Limitation: Trio Electric & Automation (M) Sdn Bhd does not collect, process or handle installation payments and shall not be held liable for installation workmanship, verbal quotes, on-site disputes or property damage caused during installation works.
- Product Warranty
All new units carry the manufacturer’s standard warranty of 1 Year General Warranty and 5 Years Compressor Warranty as provided by Mitsubishi Heavy Industries.
- Warranty Validation: Warranty coverage is contingent upon the unit being installed by a qualified technician in accordance with manufacturer specifications and maintained under normal operating conditions.
- Claims & Assessment: All post-delivery functional claims are subject to technical evaluation by authorised service personnel to determine if the fault is a manufacturing defect.
- Voided Warranty: Warranty coverage is rendered void if the product is tampered with, altered, misused, neglected, installed contrary to manufacturer specifications, or damaged due to improper electrical supply, power surges or natural disasters.
- Limitation of Liability
To the maximum extent permitted under Malaysian law:
- Trio Electric & Automation (M) Sdn Bhd shall not be liable for any indirect, incidental, punitive or consequential damages (including loss of profits, downtime, or property damage) arising from product usage, delivery disruptions, or third-party service provider performance (including independent logistics partners and customer-appointed installers).
- Our total aggregate financial liability for any claim arising out of or in connection with any purchase shall strictly not exceed the total amount paid by the customer to us for that specific order, except where such liability cannot be excluded under Malaysian law.
- Returns & Refunds
Requests for returns, exchanges, or refunds are handled in accordance with our Returns & Refunds Policy, available on this website. This is in addition to, and does not affect, your statutory rights under the Consumer Protection Act 1999. - Intellectual Property
All content on this website, including text, images, logos, and product descriptions, is owned by or licensed to Trio Electric & Automation (M) Sdn Bhd or Mitsubishi Heavy Industries, and is protected under the Copyright Act 1987 and Trade Marks Act 2019 of Malaysia. You may not reproduce, distribute, or use this content for commercial purposes without our prior written consent. - Force Majeure
We shall not be liable for any delay or failure in fulfilling our obligations under these Terms where such delay or failure arises from circumstances beyond our reasonable control, including but not limited to severe weather conditions, floods, natural disasters, civil unrest, government actions, labour disputes, transport failures or supply chain disruptions. - Governing Law & Jurisdiction
These terms are governed by and construed in accordance with the laws of Malaysia. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Malaysia. - Severability
If any provision of these Terms & Conditions is found to be invalid or unenforceable, such invalidity shall not affect the remaining provisions, which shall continue in full force and effect.
